Changed conditions for office lease in Turkey

In 2023 the conditions for renting office space have changed in Turkey. Tenants can now terminate a lease without paying compensation if the office is located in an unsafe building. This decision was taken by the Supreme Court of Turkey.

At the moment, in major cities of Turkey, buildings are being tested for compliance with safety requirements and seismic resistance. If it turns out that the premises do not meet the standards, then the tenants can terminate the lease agreements, regardless of the duration of their validity.

As for the increase in the cost of rent, here the law so far only protects tenants of residential premises. When prolonging apartment rental contracts, the rent can only increase by 25%. Taking into account the change in the Consumer Price Index by 57.7% year on year and by 6.65% in the last month, if the lease is extended in March, the rate will be already 54.7%. The cost of rent will increase by more than 1.5 times.
